1. الغرض

تهدف هذه السياسة إلى توفير مسطرة واضحة وعادلة وميسرة لتقديم الشكاوى المتعلقة بالخدمات التعليمية أو الإدارية أو التقنية أو المالية أو بخدمات دعم العملاء.

وتنظر الأكاديمية إلى الشكاوى بوصفها مصدرًا مهمًا للتغذية الراجعة وفرصة لتصحيح الأخطاء وتحسين الخدمات وتعزيز المساءلة وحماية حقوق ومصالح المتعلمين والعملاء والمدربين والشركاء وباقي الأطراف المعنية.

2. نطاق التطبيق

تطبق هذه السياسة على الشكاوى المتعلقة، من بين أمور أخرى، بما يلي:

  • معلومات البرامج أو القبول أو التسجيل أو الالتحاق؛
  • تقديم الدورات أو الجداول أو الولوج أو المواد التعليمية أو الدعم الأكاديمي؛
  • الموظفون أو الأساتذة أو المدربون أو المتعاقدون أو الممثلون العاملون باسم الأكاديمية؛
  • المدفوعات أو الفواتير أو الاستردادات أو المحاسبة أو الإدارة المالية؛
  • الشهادات أو سجلات الحضور أو إدارة التقييمات أو خدمات التحقق؛
  • منصة التعلم أو الموقع الإلكتروني أو الأنظمة التقنية أو الخدمات الرقمية؛
  • الخصوصية أو السرية أو معالجة البيانات أو إمكانية الوصول أو التواصل؛
  • الشراكات أو الخدمات المؤسسية أو خدمات دعم العملاء.
تختلف الشكوى عن الاستفسار العادي أو طلب الدعم التقني أو الطعن في نتيجة أو طلب حماية البيانات أو طلب الاسترداد. وعندما تكون هناك سياسة أو مسطرة أخرى أكثر ملاءمة، يجوز للأكاديمية إحالة الموضوع إليها وإخبار المشتكي بذلك.

3. المبادئ الموجهة

  • سهولة الولوج: يمكن تقديم الشكاوى عبر قنوات واضحة وعملية.
  • الإنصاف: تتم مراجعة كل شكوى بموضوعية ودون تحيز غير مشروع.
  • التناسب: يتناسب مستوى البحث مع خطورة الشكوى وتعقيدها.
  • السرية: لا تشارك المعلومات إلا مع الأشخاص الذين تستدعي الحاجة اطلاعهم عليها.
  • الاحترام: يتعين على جميع الأطراف التواصل بمهنية ودون إساءة أو تهديد.
  • عدم الانتقام: لا يتعرض أي شخص للضرر بسبب تقديم شكوى حقيقية بحسن نية.
  • التحسين: قد تستخدم المشكلات المتكررة لتحسين السياسات والتكوين والأنظمة والخدمات.

4. كيفية تقديم الشكوى

يفضل تقديم الشكاوى كتابيًا حتى يتم تسجيل الموضوع بدقة ومراجعته بكفاءة.

اشرح ما وقع، ومتى وقع، والبرنامج أو الخدمة أو المعاملة أو الشخص المعني.

أرفق الأسماء والتواريخ وبيانات التسجيل ومراجع الدفع واللقطات والرسائل أو الوثائق ذات الصلة.

بيان النتيجة المطلوبة

وضح الحل الذي تراه مناسبًا، مع العلم أن الحل النهائي يجب أن يكون قانونيًا ومنصفًا ومتناسبًا.

إرسال الشكوى

أرسل الشكوى إلى contact@coursesida.com مع كتابة «شكوى رسمية» في موضوع الرسالة.

يمكن كذلك تسليم الشكاوى إلى فرع الأكاديمية بفاس أو تقديمها هاتفيًا أو عبر واتساب. ومع ذلك، يجوز للأكاديمية طلب تأكيد كتابي قبل فتح ملف شكوى رسمي.

5. المعلومات الواجب تضمينها

لمساعدة الأكاديمية على تقييم الموضوع، ينبغي أن تتضمن الشكوى ما يلي:

  • الاسم الكامل للمشتكي وبيانات التواصل معه؛
  • بيانات البرنامج أو الخدمة أو الطلب أو الفاتورة أو الشهادة أو الحساب المعني؛
  • وصف واضح للشكوى؛
  • التواريخ ذات الصلة وأسماء الأشخاص المعنيين متى كانت معروفة؛
  • نسخ من الأدلة المؤيدة؛
  • تفاصيل أي محاولة سابقة لحل الموضوع؛
  • النتيجة أو الحل المطلوب.

يمكن النظر في الشكاوى المجهولة عندما تكون المعلومات المقدمة دقيقة بما يكفي ويثير الموضوع قلقًا جديًا. غير أن عدم الكشف عن الهوية قد يحد من قدرة الأكاديمية على البحث والتحقق من الوقائع والتواصل أو تقديم حل شخصي.

6. أجل تقديم الشكوى

ينبغي تقديم الشكوى في أقرب وقت ممكن، ويفضل خلال 30 يومًا تقويميًا من الواقعة أو القرار أو السلوك موضوع الشكوى.

يجوز للأكاديمية النظر في شكوى أقدم إذا وجد مبرر معقول للتأخر، أو ظل الموضوع قابلًا لمراجعة عادلة، أو كانت الشكوى تتعلق بمسألة خطيرة أو متكررة أو بحماية الأشخاص أو بمسألة قانونية أو مؤسسية.

7. مسطرة معالجة الشكوى

7.1 التقييم الأولي

تراجع الأكاديمية الشكوى لتحديد طبيعتها ودرجة استعجالها ونطاقها والقسم المختص، وما إذا كانت سياسة أو مسطرة أخرى هي الواجب تطبيقها.

7.2 الحل غير الرسمي

عندما يكون ذلك مناسبًا، يمكن حل المشكلات البسيطة بسرعة عن طريق التوضيح أو التصحيح أو الاستبدال أو المساعدة التقنية أو الاعتذار أو أي إجراء عملي آخر.

7.3 المراجعة الرسمية

يمكن إسناد الشكوى الرسمية إلى مسؤول أو مدير أو مراجع مناسب لم يكن مسؤولًا مباشرة عن الموضوع، متى كان الاستقلال في المراجعة مطلوبًا بصورة معقولة.

7.4 الأدلة والتواصل

يجوز للمراجع فحص السجلات والمراسلات وسجلات المنصة والسياسات والعقود والفواتير وبيانات الحضور والتقييمات أو أي معلومات أخرى ذات صلة. كما يجوز للأكاديمية طلب توضيحات أو أدلة إضافية من المشتكي أو من أطراف أخرى.

7.5 النتيجة

تبلغ الأكاديمية النتيجة كتابيًا متى كان ذلك عمليًا. وقد يتضمن الرد النتائج والإجراءات المتخذة والحل المتاح وأسباب القرار وأي خيار للمراجعة أو الاستئناف.

8. آجال الاستجابة

تأكيد الاستلام عادة خلال 5 أيام عمل.
المراجعة الأولية عادة خلال 10 أيام عمل.
الرد النهائي عادة خلال 30 يومًا تقويميًا.

قد تتطلب الشكاوى المعقدة مدة إضافية، خصوصًا عندما تشمل عدة أطراف أو مزودي خدمات خارجيين أو سجلات مؤرشفة أو مسائل قانونية أو أدلة تقنية مفصلة. وفي هذه الحالات، تسعى الأكاديمية إلى تقديم تحديث بشأن التقدم وتاريخ متوقع جديد للرد.

تمثل هذه المدد أهدافًا خدمية وليست آجالًا قانونية مضمونة. وقد تطبق مدة مختلفة إذا كان القانون أو العقد أو مسطرة مزود الدفع أو سياسة أخرى يفرض ذلك.

9. النتائج والحلول الممكنة

يجوز للأكاديمية، بحسب ظروف كل حالة، اتخاذ واحد أو أكثر من الإجراءات الآتية:

  • تقديم تفسير أو توضيح أو تصحيح؛
  • تقديم اعتذار؛
  • استعادة الولوج أو تصحيح السجلات أو إعادة إصدار الوثائق؛
  • تقديم مساعدة تقنية أو إدارية؛
  • مراجعة تقييم أو سجل حضور أو شهادة أو فاتورة أو قرار متعلق بالخدمة؛
  • تقديم خدمة بديلة أو رصيد أو استرداد أو تعويض مالي آخر عندما يكون مبررًا ومسموحًا؛
  • تقديم توجيه أو تكوين أو إشراف أو إجراء تصحيحي للموظفين؛
  • تعديل مسطرة أو سياسة أو نظام أو وسيلة تواصل؛
  • رفض الشكوى إذا كانت غير مدعمة أو خارج النطاق أو مسيئة أو متكررة أو غير مناسبة لمزيد من المراجعة.

تحدد الأكاديمية الحلول بناءً على الوقائع والشروط المطبقة والالتزامات التعاقدية والإنصاف والتناسب والمتطلبات القانونية ذات الصلة.

10. طلب المراجعة أو الاستئناف

يمكن للمشتكي الذي لا يزال غير راضٍ طلب مراجعة داخلية خلال 10 أيام عمل من تاريخ توصله بالرد النهائي.

ينبغي أن يوضح طلب المراجعة ما يلي:

  • النتيجة محل الاعتراض؛
  • سبب اعتبار المراجعة الأصلية ناقصة أو غير صحيحة؛
  • أي دليل جديد مهم لم يكن متاحًا سابقًا؛
  • النتيجة المعدلة المطلوبة.

لا يعد الاستئناف إعادة كاملة للنظر في الشكوى لمجرد عدم الاتفاق مع النتيجة. وتركز المراجعة عادة على عدالة المسطرة أو الخطأ الواقعي الجوهري أو الدليل الجديد ذي الصلة أو القرار غير المعقول أو غير المتناسب.

يمثل قرار المراجعة الداخلية عادة الموقف الداخلي النهائي للأكاديمية.

11. السلوك غير المعقول أو المسيء أو المتكرر

لا ترفض الأكاديمية الشكوى لمجرد أنها ناقدة أو مصاغة بلهجة قوية. غير أنه يجوز لها تقييد التواصل أو إيقافه عندما تكون المراسلات تهديدية أو تمييزية أو مسيئة أو مضايقة أو كاذبة عمدًا أو مفرطة في التكرار أو تهدف إلى تعطيل سير العمل.

عندما يكون ذلك معقولًا، يجوز للأكاديمية تحديد قناة تواصل واحدة أو طلب المراسلة الكتابية أو وضع حدود متناسبة للتواصل أو رفض إعادة النظر في موضوع استنفد مسطرة الشكوى والاستئناف دون وجود دليل جديد مهم.

12. السرية والبيانات الشخصية

تعالج معلومات الشكوى وفق سياسة الخصوصية الخاصة بالأكاديمية ومتطلبات حماية البيانات المطبقة. ويجوز مشاركة المعلومات داخليًا أو مع مزودي الخدمات أو الأساتذة أو الشركاء أو المستشارين أو شركات التأمين أو معالجي الدفع أو السلطات، عندما يكون ذلك ضروريًا بصورة معقولة للمراجعة أو الحل أو التوثيق أو الامتثال للالتزامات القانونية.

لا يمكن للأكاديمية ضمان السرية المطلقة عندما يكون الكشف ضروريًا لتحقيق مراجعة عادلة أو لأغراض الحماية أو الامتثال القانوني أو منع الاحتيال أو الدفاع عن المطالبات القانونية أو حماية الحقوق والسلامة.

13. سجلات الشكاوى وتحسين الخدمات

يجوز للأكاديمية الاحتفاظ بسجلات الشكاوى والمراسلات والأدلة والنتائج والحلول لأغراض إدارية وقانونية ورقابية وضمان الجودة وتحسين الخدمات.

كما يجوز تحليل بيانات الشكاوى بصورة مجمعة أو بعد إزالة ما يدل على الهوية لتحديد المشكلات المتكررة وتحسين التكوين ومراجعة السياسات وتطوير الأنظمة وتعزيز تجربة المتعلم والعميل.

14. التصعيد إلى الجهات الخارجية

لا تمنع هذه السياسة أي شخص من التواصل مع جهة تنظيمية مختصة أو هيئة لحماية المستهلك أو محكمة أو مزود دفع أو سلطة لحماية البيانات أو جهة لإنفاذ القانون أو أي مؤسسة مخولة، متى كان له هذا الحق.

وتشجع الأكاديمية، متى كان ذلك مناسبًا، على استعمال المسطرة الداخلية قبل التصعيد الخارجي حتى تتاح مراجعة الموضوع ومحاولة حله مباشرة.

تختلف الجهة الخارجية المختصة بحسب طبيعة الشكوى ومكان المشتكي والجهة المتعاقدة والخدمة المعنية والقانون المطبق. ولا تقدم الأكاديمية استشارة قانونية.

15. بيانات التواصل الخاصة بالشكاوى

ينبغي تمييز الشكاوى الرسمية بعبارة «شكوى رسمية» وإرسالها إلى:

17. تعديل السياسة

يجوز للأكاديمية تحديث هذه السياسة لتعكس التغيرات في الخدمات أو المساطر الداخلية أو المتطلبات القانونية أو التكنولوجيا أو الهيكلة المؤسسية. وتطبق أحدث نسخة منشورة على موقع الأكاديمية ابتداءً من تاريخ سريانها المحدد.

1. Purpose

The purpose of this policy is to provide a clear, fair, and accessible process for submitting and resolving complaints relating to the Academy’s educational, administrative, technical, financial, or customer-support services.

The Academy views complaints as an important source of feedback and an opportunity to correct mistakes, improve services, strengthen accountability, and protect the rights and interests of learners, customers, instructors, partners, and other stakeholders.

2. Scope

This policy applies to complaints concerning, among other matters:

  • program information, enrollment, admission, or registration;
  • course delivery, scheduling, access, learning materials, or academic support;
  • staff, instructors, trainers, contractors, or representatives acting for the Academy;
  • payments, invoices, refunds, billing, or other financial administration;
  • certificates, attendance records, assessment administration, or verification services;
  • the learning platform, website, technical systems, or digital services;
  • privacy, confidentiality, data handling, accessibility, or communication;
  • partnership, institutional, or customer-support services.
A complaint is different from a routine inquiry, technical support request, grade appeal, data-protection request, or refund request. Where another policy or process is more appropriate, the Academy may redirect the matter and inform the complainant accordingly.

3. Guiding Principles

  • Accessibility: complaints may be submitted through clear and practical channels.
  • Fairness: each complaint will be reviewed objectively and without improper bias.
  • Proportionality: the level of investigation will reflect the seriousness and complexity of the complaint.
  • Confidentiality: information will be shared only with persons who need it to review or resolve the matter.
  • Respect: all parties are expected to communicate professionally and without abusive language or conduct.
  • No retaliation: no person will be disadvantaged for raising a genuine complaint in good faith.
  • Improvement: recurring or systemic issues may be used to improve policies, training, systems, and services.

4. How to Submit a Complaint

Complaints should preferably be submitted in writing so that the issue can be recorded accurately and reviewed efficiently.

Identify the matter

Explain what happened, when it happened, and which program, service, transaction, or person is involved.

Provide supporting information

Include relevant names, dates, registration details, payment references, screenshots, messages, or documents.

State the requested outcome

Explain what resolution you consider appropriate, while recognising that the final outcome must be lawful, fair, and proportionate.

Send the complaint

Email the complaint to contact@coursesida.com with the subject line “Formal Complaint”.

Complaints may also be delivered through the Fez branch or communicated by telephone or WhatsApp. However, the Academy may request written confirmation before opening a formal complaint file.

5. Information to Include

To help the Academy assess the matter, a complaint should include:

  • the complainant’s full name and contact details;
  • the relevant program, service, order, invoice, certificate, or account details;
  • a clear description of the complaint;
  • relevant dates and the names of persons involved, where known;
  • copies of supporting evidence;
  • details of any previous attempt to resolve the issue;
  • the outcome or remedy being requested.

Anonymous complaints may be considered where the information is sufficiently specific and the matter raises a serious concern. However, anonymity may limit the Academy’s ability to investigate, verify facts, communicate, or provide a personal remedy.

6. When to Complain

Complaints should normally be submitted as soon as reasonably possible and preferably within 30 calendar days of the event, decision, or conduct concerned.

The Academy may consider an older complaint where there is a reasonable explanation for the delay, the matter remains capable of fair review, or the complaint raises a serious, recurring, safeguarding, legal, or institutional concern.

7. Complaint Handling Process

7.1 Initial assessment

The Academy will review the complaint to determine its nature, urgency, scope, responsible department, and whether another policy or procedure applies.

7.2 Informal resolution

Where appropriate, straightforward concerns may be resolved promptly through clarification, correction, replacement, technical assistance, apology, or another practical action.

7.3 Formal review

A formal complaint may be assigned to an appropriate manager, officer, or reviewer who was not directly responsible for the matter where independence is reasonably required.

7.4 Evidence and communication

The reviewer may examine records, correspondence, platform logs, policies, contracts, invoices, attendance data, assessments, or other relevant information. The Academy may ask the complainant or other persons to provide clarification or additional evidence.

7.5 Outcome

The Academy will communicate the outcome in writing where practicable. The response may explain the findings, actions taken, available remedy, reasons for the decision, and any further review or appeal option.

8. Response Timelines

Acknowledgment Normally within 5 business days.
Initial Review Normally within 10 business days.
Final Response Normally within 30 calendar days.

Complex complaints may require additional time, particularly where multiple parties, external providers, archived records, legal issues, or detailed technical evidence are involved. In such cases, the Academy will aim to provide a progress update and a revised expected response date.

These periods are service targets rather than guaranteed statutory deadlines. A different period may apply where required by law, contract, payment-provider procedure, or another applicable policy.

9. Possible Outcomes and Remedies

Depending on the circumstances, the Academy may:

  • provide an explanation, clarification, or correction;
  • issue an apology;
  • restore access, correct records, or reissue documentation;
  • provide technical or administrative assistance;
  • review an assessment, attendance record, certificate, invoice, or service decision;
  • offer a replacement service, credit, refund, or other financial remedy where justified and permitted;
  • provide staff guidance, training, supervision, or corrective action;
  • amend a process, policy, system, or communication;
  • decline the complaint where it is unsupported, outside scope, abusive, repetitive, or otherwise unsuitable for further review.

The Academy will determine remedies based on the facts, applicable terms, contractual obligations, fairness, proportionality, and any relevant legal requirements.

10. Review or Appeal

A complainant who remains dissatisfied may request an internal review within 10 business days of receiving the final response.

The request should clearly identify:

  • the outcome being challenged;
  • the reason the original review is considered incomplete or incorrect;
  • any significant new evidence that was not previously available;
  • the revised outcome being requested.

An appeal is not a complete rehearing of the complaint merely because the complainant disagrees with the outcome. The review will generally focus on procedural fairness, material factual error, relevant new evidence, or an unreasonable or disproportionate decision.

The internal review decision will normally represent the Academy’s final internal position.

11. Unreasonable, Abusive, or Repetitive Conduct

The Academy will not refuse a complaint merely because it is critical or strongly expressed. However, it may limit or discontinue contact where communications are threatening, discriminatory, abusive, harassing, knowingly false, excessively repetitive, or intended to obstruct operations.

Where reasonable, the Academy may designate a single contact channel, request written communication, set proportionate communication limits, or decline to reconsider matters that have already completed the complaint and appeal process without significant new evidence.

12. Confidentiality and Personal Data

Complaint information will be handled in accordance with the Academy’s Privacy Policy and applicable data-protection requirements. Information may be shared internally or with relevant service providers, instructors, partners, advisers, insurers, payment processors, or authorities where reasonably necessary to review, resolve, document, or comply with legal obligations.

The Academy cannot guarantee absolute confidentiality where disclosure is necessary for a fair review, safeguarding, legal compliance, fraud prevention, defence of legal claims, or protection of rights and safety.

13. Complaint Records and Service Improvement

The Academy may retain complaint records, correspondence, evidence, findings, and outcomes for legitimate administrative, legal, compliance, quality-assurance, and service-improvement purposes.

Complaint data may be analysed in aggregated or de-identified form to identify recurring issues, improve training, revise policies, enhance systems, and strengthen learner and customer experience.

14. External Escalation

This policy does not prevent any person from contacting a competent regulator, consumer-protection authority, court, payment provider, data-protection authority, law-enforcement body, or other authorised institution where such a right exists.

Before external escalation, the Academy encourages complainants to use the internal process where appropriate, so that the matter can be reviewed and, where possible, resolved directly.

The appropriate external body depends on the nature of the complaint, the complainant’s location, the contracting entity, the service involved, and applicable law. The Academy does not provide legal advice.

17. Policy Changes

The Academy may update this policy to reflect changes in services, internal procedures, legal requirements, technology, or institutional structure. The latest version published on the Academy’s website will apply from its stated effective date.
