تدعم الشركة المغربية تشغيل خدمات الأكاديمية في المغرب وفق الترتيبات المؤسسية المعتمدة مع الشركة الأمريكية. وقد تشمل أنشطتها الدعم الإداري والأكاديمي، والتنسيق مع الطلبة والمدربين، والإدارة التقنية ودعم المنصة، وخدمة العملاء، ودعم الصيانة والنسخ الاحتياطي، والتنسيق مع مقدمي الخدمات المحليين.

يجوز لها معالجة البيانات نيابة عن الشركة الأمريكية عند تقديم هذه الخدمات، وتعمل مسؤولًا مستقلًا فقط بالنسبة إلى التزاماتها وأنشطتها المغربية الخاصة، بما فيها المحاسبة والضرائب والعمل والبنوك والامتثال التنظيمي والقانوني.

4.3 معلومات التحقق من الهوية

قد نطلب بطاقة الهوية أو جواز السفر أو وثيقة الإقامة أو رقمها أو التوقيع أو معلومات تحقق إضافية عندما يكون ذلك ضروريًا للتسجيل أو إصدار شهادة أو منع الانتحال أو الامتثال للقانون أو التحقيق في الاحتيال.

4.4 بيانات الدفع والفوترة

قد تشمل المبلغ وتاريخ الدفع وطريقته ومراجع التحويل والفواتير والإيصالات والأقساط والرصيد واسم الدافع وعنوان الفوترة ومعرف المعاملة وحالة الدفع والاسترداد والمعلومات المحدودة الواردة من البنك أو مزود الدفع.

قد تشمل بيانات الهوية والتواصل والمؤهلات والخبرات والعقود والمراسلات والبيانات البنكية اللازمة للأداء والسير المهنية والصور والتسجيلات والسجلات الإدارية.

4.7 البيانات التقنية وبيانات الاستخدام

قد تشمل عنوان IP ونوع الجهاز والمتصفح ونظام التشغيل واللغة والمنطقة الزمنية وسجلات الدخول والصفحات والروابط والتوقيت والنشاط والأخطاء ومحاولات الدخول غير المصرح وملفات الارتباط.

4.8 بيانات المراسلات والدعم

قد نحتفظ بالرسائل والمرفقات الواردة عبر البريد وواتساب والهاتف والاستمارات وقنوات الدعم للرد وحل المشكلات وتوثيق الإجراءات والتحقيق في الشكاوى وحماية الحقوق.

5. مصادر البيانات الشخصية

قد نحصل على البيانات مباشرة منكم أو من ولي الأمر أو الممثل القانوني أو مؤسسة راعية أو مدرب مخول أو بنك أو مزود دفع أو مقدم خدمة تقني أو تلقائيًا من الجهاز والمتصفح أو من مصادر مهنية عامة أو من شخص مخول قانونًا.

ويقر من يقدم بيانات تخص شخصًا آخر بأن لديه السلطة أو الأساس القانوني اللازم لتقديمها.

6. أغراض معالجة البيانات

6.1 التسجيل والإدارة التعليمية

استقبال الطلبات، وإنشاء الحسابات والسجلات، والتحقق من شروط الالتحاق، وتنظيم الجلسات، وإدارة الحضور، وإجراء التقييمات، وتقديم المحتوى، ومتابعة التقدم، وإرسال الإشعارات.

6.2 إدارة الشهادات والوثائق

تحديد الأهلية، وإصدار الشهادات والإفادات، وحفظ سجلات الخريجين، وتقديم التحقق الإلكتروني، وإعادة إصدار الوثائق، ومنع التزوير.

6.3 الدفع والفوترة والمحاسبة

تحصيل المدفوعات ومطابقتها، وإدارة الأقساط، وإصدار الفواتير والإيصالات، ومعالجة الاستردادات المستحقة، وحفظ المعاملات، والامتثال المحاسبي والضريبي، ومنع الاحتيال، والرد على النزاعات وعمليات Chargebacks.

6.4 التواصل والدعم

إرسال معلومات التسجيل والجلسات والروابط، والرد على الاستفسارات والشكاوى، وتقديم الدعم، والتواصل بشأن الحساب والدفع والشهادات.

6.5 الأمن ومنع الاحتيال والحماية القانونية

تأمين الأنظمة والحسابات، وكشف الدخول غير المصرح، ومنع الانتحال والغش والاحتيال، والتحقيق في المعاملات المشبوهة، والتحقق من الهوية، وحفظ سجلات التدقيق والموافقات، وحماية الحقوق، والامتثال للطلبات القانونية.

6.6 تحسين الخدمات وضمان الجودة

تقييم الأداء والاستخدام والرضا، وتحسين المحتوى، وحل المشكلات، وتحسين التجربة، وإعداد الإحصاءات، مع استخدام البيانات المجمعة أو المجهلة متى أمكن.

6.7 التسويق

عندما يسمح القانون أو بناء على موافقة صحيحة، قد نعلن عن البرامج والأخبار والفعاليات وننشر الشهادات أو الصور أو التسجيلات بعد الحصول على الإذن المناسب. ويمكن الانسحاب في أي وقت.

7. الأسس القانونية للمعالجة

بحسب المعالجة والقانون المطبق، نستند إلى اتخاذ خطوات قبل التعاقد، أو تنفيذ العقد، أو الالتزامات القانونية والضريبية والمحاسبية، أو الموافقة، أو المصالح المشروعة المتوازنة مع الحقوق، أو حماية الأنظمة والمعاملات والحقوق، أو إثبات الدعاوى والدفاع عنها، أو أي أساس قانوني آخر.

يمكن سحب الموافقة في أي وقت دون المساس بقانونية المعالجة السابقة، وقد تستمر المعالجة إذا وجد أساس قانوني آخر.

8. المدفوعات الإلكترونية ومقدمو خدمات الدفع

8.1 معالجة المدفوعات بواسطة أطراف ثالثة

قد تعالج المدفوعات بواسطة بنوك أو مؤسسات اقتناء أو بوابات أو معالجي دفع أو محافظ رقمية مستقلة، وقد تجمع هذه الجهات بيانات البطاقة والفوترة والبنك والجهاز والمعاملة والمصادقة ومؤشرات الاحتيال وفق سياساتها.

8.2 بيانات البطاقات التي لا تخزنها الأكاديمية

ما لم يذكر خلاف ذلك لطريقة محددة، لا تخزن الأكاديمية مباشرة أرقام البطاقات الكاملة أو CVV/CVC/CID أو بيانات الشريط أو PIN أو بيانات المصادقة الحساسة. وقد تستلم فقط معلومات محدودة مثل اسم الدافع ومرجع العملية والمبلغ والتاريخ والحالة وآخر أربعة أرقام ونوع البطاقة وحالة الاسترداد وإشعارات النزاع.

8.3 أمن الدفع

تسعى الأكاديمية إلى استخدام مزودين موثوقين يطبقون ضوابط أمنية معترفًا بها ومعيار PCI DSS حيث ينطبق.

8.4 منع الاحتيال والتحقق

قد تعالج الأكاديمية ومزودوها بيانات الهوية والجهاز والشبكة والسلوك للتحقق من الدافع، واعتماد أو رفض المعاملة، وكشف النشاط المشبوه، وتطبيق 3-D Secure، والامتثال للالتزامات النظامية، والتحقيق في النزاعات.

8.5 المدفوعات المتكررة أو الأقساط

قد يحتفظ المزود برمز آمن لطريقة الدفع لتنفيذ مدفوعات مستقبلية مصرح بها، ولا تستلم الأكاديمية الرقم الكامل للبطاقة، ويتم بيان المبلغ والتكرار والمدة وشروط الإلغاء قبل البدء.

8.6 الاستردادات

تحدد الأهلية وفق سياسة الاسترداد والإلغاء واتفاق التسجيل وشروط البرنامج والقانون الملزم. وعادة يعاد المبلغ إلى وسيلة الدفع الأصلية، وقد يختلف زمن ظهوره بحسب البنك والمزود والشبكة والعملة والدولة.

8.7 النزاعات وعمليات Chargebacks

قد تقدم الأكاديمية أدلة لازمة مثل سجلات التسجيل والدفع والفواتير والولوج والحضور والمراسلات وقبول الشروط وسجل الاسترداد وإثبات تقديم الخدمة.

8.8 تحويل العملات والرسوم البنكية

قد تطبق البنوك أو المزودون أسعار صرف ورسوم معاملات دولية ومعالجة وبنوك وسيطة، ما لم تصرح الأكاديمية بخلاف ذلك.

9. التسجيلات التعليمية والصور والصوت

قد تسجل الجلسات والمحاضرات والاجتماعات لأغراض إتاحة المحتوى والتوثيق وضمان الجودة والتدريب الداخلي والتحقيق في الشكاوى وحماية الحقوق. ويُشعر المشاركون متى أمكن.

قد يظهر في التسجيل الاسم والصورة والصوت والأسئلة والتعليقات والدردشة والمحتوى المعروض. ويمكن إيقاف الكاميرا أو الميكروفون عندما تكون المشاركة اختيارية.

لا تستخدم المواد القابلة للتعرف في الإعلانات العامة دون أساس قانوني أو موافقة مناسبة.

10. الأطفال والقاصرون ودراسات الحالات

لا تستهدف الخدمات العامة قاصرين لا يملكون أهلية التسجيل المستقل إلا عبر ولي أو ممثل قانوني أو مؤسسة مخولة. وقد نطلب موافقة الولي والتحقق من صفته وجمع الحد الأدنى وتقييد التسجيل والإفصاح وتطبيق ضمانات إضافية.

يمنع رفع معلومات قابلة للتعرف عن الأطفال أو أصحاب الحالات، مثل الأسماء والصور والأرقام والعناوين والمدارس والتقارير الطبية أو النفسية أو التربوية ومعلومات الأسرة. ويجب إخفاء الهوية بفعالية ما لم يوجد أساس قانوني وموافقة وضمانات مناسبة.

11. ملفات تعريف الارتباط والتقنيات المشابهة

قد يستخدم الموقع ملفات ضرورية للتشغيل والأمان والدخول، وملفات تفضيلات وتحليلات وتسويق. وعندما تتطلب الملفات غير الضرورية موافقة، لا تُفعّل قبل اختيار المستخدم.

يمكن إدارة الملفات عبر أداة التفضيلات، إن توفرت، أو إعدادات المتصفح، وقد تنشر الأكاديمية سياسة ملفات ارتباط مستقلة تتضمن الأسماء والمزودين والأغراض والمدد.

12. مشاركة البيانات الشخصية

لا تبيع الأكاديمية البيانات ولا تؤجرها. وقد تشاركها عند الضرورة مع الموظفين والمدربين المخولين، ومقدمي التقنية والاستضافة وZoom والسحابة والتحليلات والدعم، ومزودي الدفع والبنوك والشبكات ومكافحة الاحتيال، والمستشارين، والشركاء التعليميين، والسلطات، أو جهة خلف عند إعادة الهيكلة، وفق الضمانات المناسبة.

13. النقل الدولي للبيانات

قد تخزن البيانات أو تعالج خارج المغرب أو خارج دولة الشخص بسبب مزودي التقنية والدفع والسحابة والاتصال، وقد تنتقل أو تصبح متاحة بين الشركة الأمريكية والشركة المغربية عند الضرورة لتقديم الخدمات أو إدارة الموقع والمنصة أو الامتثال للقانون.

عندما يخضع النقل لقيود قانونية، قد نستخدم إجراءات التصريح أو الترخيص، أو الموافقة الصريحة، أو الالتزامات التعاقدية، أو تقليل البيانات، أو التحكم في الوصول، أو التشفير، أو آلية قانونية أخرى.

14. مدة الاحتفاظ بالبيانات

بعد انتهاء المدة، تحذف البيانات أو تتلف أو تُجعل مجهلة، وقد تبقى نسخ احتياطية محدودة إلى أن تستبدل وفق الدورة المعتادة.

15. أمن البيانات وضوابط الوصول

تضع الشركة الأمريكية المتطلبات المؤسسية للخصوصية والأمن والوصول والاحتفاظ، وتدير الشركة المغربية بعض التدابير التقنية والتشغيلية في المغرب، وتطبق تدابيرها الخاصة بالنسبة إلى المعالجات التي تكون مسؤولة عنها بصورة مستقلة.

قد تشمل التدابير الصلاحيات حسب الدور، وقصر الوصول، وسحب الصلاحيات، وكلمات المرور القوية، والمصادقة متعددة العوامل، والتحديثات، وحماية حسابات الاستضافة وقواعد البيانات والبريد وZoom، والتشفير، والنسخ الاحتياطي، والمراقبة، والسرية، ومراجعة المزودين، وضوابط الاحتيال، والاستجابة للحوادث.

لا يمكن ضمان الأمان المطلق، وعلى المستخدم حماية بيانات دخوله وعدم مشاركتها.

16. خروقات البيانات والحوادث الأمنية

عند وقوع حادث قد نقيم طبيعته ونطاقه، ونحتويه ونحقق فيه، ونتخذ إجراءات تصحيحية، ونوثقه، ونخطر السلطات أو الأشخاص عندما يفرض القانون، ونعمل على الحد من تكراره. وقد تتعاون الشركتان في الحوادث التي تمس الأنظمة أو المستخدمين أو البيانات المشتركة.

17. حقوقكم في الخصوصية

بحسب القانون المطبق، قد يحق لكم الحصول على معلومات، والوصول إلى البيانات، والتصحيح، والاعتراض، والحذف أو الحجب أو وقف المعالجة حيث يسمح القانون، وسحب الموافقة، وتقييد المعالجة، ونقل البيانات، والمراجعة البشرية لبعض القرارات الآلية، وتقديم شكوى إلى السلطة المختصة.

لا تتخذ الأكاديمية عادة قرارات أكاديمية نهائية ذات أثر مهم بالاعتماد الحصري على معالجة آلية دون مراجعة بشرية مناسبة.

18. كيفية ممارسة الحقوق

يرجى تضمين الاسم الكامل، والبريد الإلكتروني أو رقم الهاتف المرتبط بالحساب، والبرنامج أو الخدمة، ووصف الطلب، ومعلومات التحقق المعقولة.

قد نطلب تحققًا إضافيًا، وقد يرفض أو يقيد الطلب في الحالات التي يسمح بها القانون، ومنها تعذر التحقق أو المساس بحقوق الغير أو وجود التزام قانوني بالاحتفاظ أو الحاجة إلى البيانات للدفاع عن الحقوق.

لا تبيع الأكاديمية البيانات للمعلنين أو وسطاء البيانات، ولا تعامل ملفات الطلبة أو السجلات التعليمية أو معلومات الدفع أو النشاط الأكاديمي كمنتجات بيانات تجارية.

21. البيانات المجمعة ومجهلة الهوية

قد تستخدم الأكاديمية بيانات مجمعة أو إحصائية أو مجهلة لأغراض التخطيط والتقييم والجودة والبحث والتطوير والتقارير والتحسين، ولا تعد البيانات مجهلة إلا إذا تعذر ربطها بصورة معقولة بشخص محدد.

22. روابط وخدمات الأطراف الثالثة

قد يتضمن الموقع روابط لخدمات مستقلة، ولا تتحمل الأكاديمية مسؤولية ممارساتها أو أمنها أو محتواها أو توفرها. وينبغي مراجعة سياساتها وشروطها قبل تقديم بيانات شخصية أو مالية.

A request may be restricted or refused where permitted by law, including where identity cannot be verified, disclosure would affect another person’s rights, retention is legally required, the information is required to establish or defend legal rights, the request is manifestly excessive or abusive, or another legal exception applies.
